These are our standard offer terms and conditions. Please ensure you read the terms and conditions specific to your offer before taking up any Registered Access or subscription. If you were referred to this page by our customer support group, these are the terms and conditions relating to the offer you are seeking to subscribe to or have subscribed to.

1.       In these terms and conditions News Pty Limited will be referred to as News.

News and any of its related companies may require that users of our digital services become a registered user and ‘Create an Account’ to be entitled to engage with us in certain ways. These terms and conditions govern your Registered Access with News and your related use of that registration to access this website and any other digital media (whether existing now or in the future) owned or operated by News or any of its related companies for which you can use your Registered Access (News Digital Media). News Digital Media may include News Sites (as defined below in the governance of News Digital Media section and as amended from time to time), applications and, where relevant, any media which you can access using one of our newspaper masthead’s membership or subscription, or any membership or subscription to our digital services.

2.       Acceptance

Your Registered Access and/or your registered use of any News Digital Media indicates your acceptance of these terms. If you also subscribe to any particular offers or services, you will also be bound by terms and conditions which are specific to those offers or services, including those set out at the end of these terms and conditions.

3.       Governance of News Digital Media

3.1.    The websites that are included in your Registered Access (News Sites or “the network”) are owned by News or its related companies. The News Sites have terms and conditions which, together with these terms and conditions, govern usage of the News Sites.

3.3.    Other News Digital Media (such as applications) may also have their own specific terms of use and you should check those as your use of those News Digital Media indicates your agreement with their terms of use.

 

3.4.    News or its relevant related companies may change any applicable terms and conditions from time to time, whether in relation to specific News Digital Media, Registered Access or any membership or subscription offered by News or any of its related companies. If this happens, amendments will be posted on the affected News Sites or other News Digital Media and will also be accessible through your News Account login within My Account or we will otherwise take reasonable steps to advise you of the change. If you object to changes to any terms or conditions you may cancel your Registered Access or affected membership or subscription up to 28 days after changes come into effect without accepting the new terms and conditions. If you do not cancel or you use or access any News Sites or News Digital Media (other than to review the new terms and conditions) using your Registered Access or relevant membership or subscription within that period you will be deemed to have accepted the new terms. You may call Customer Support on 1300 MY NEWS (1300 69 63 97) (who will consider your position acting reasonably) if you have reasonable grounds for not having cancelled within the 28 day time limit and still wish to cancel.   

4.       Creating and using your Registered Access

4.1.    Your Registered Access will be valid on receipt by News of your completed and valid application. Confirmation of acceptance will be provided to you via your nominated email address. In some circumstances you may automatically obtain Registered Access through a previous registration for another of our digital services.

4.2.    Each username and password is assigned to a single user.  You must ensure that your username and password remain secure and are only shared with the residents of your household i.e. family and friends that live at the same residential address.  However you agree that your Registered Access cannot be used with more than four devices concurrently. You are responsible for all use, activities and charges associated with your username and password. Your username and password are not otherwise transferable.

4.3.    Your Registered Access may be used for non-commercial purposes only.

4.4.    You must contact News if you become aware that unauthorised use of your username and password has occurred. News may take appropriate action, such as terminating registration if you are deemed to have shared your password outside your household or have allowed unauthorised use of your username and password.

5.       Registered Access

5.1.    Registered Access requires no payment or payment details. 

5.2.    Registered Access provides you with the ability to access all unmetered content of News Sites and msites so that, when logged in with your Registered Access, if there is metered content, you will have access to a fixed number of pieces of metered content from the following News Sites and msites, within a set recurring time period:

5.3.    The precise number of pieces of metered content you will have access to with your Registered Access on these sites and the recurring time period may vary from time to time at our discretion. You will be advised when you have reached the limit and offered a digital membership. Registration may also provide other benefits which may vary at our discretion from time to time.

6.       Access from outside of Australia and other access issues

You acknowledge and agree that some of our content may not be viewable or accessible from outside of Australia and that there may be other technology or infrastructure related reasons which limit your ability to access our content at any time.

7.       Cancellation and Termination

7.1.    Your Registered Access will continue until cancelled by either one of us. Your Registered Access may be cancelled at any time by calling Customer Support on 1300 MY NEWS (1300 69 63 97)

7.2.    News reserves the right to cancel a Registered Access without notice or liability, exercised reasonably, although in most circumstances you will be given notice as to the reason for cancellation.

7.3.    Cancellation of a Registered Access will automatically cancel any related membership or subscription.

8.       Data downloads

You are responsible for downloads and any costs associated with downloading, including unauthorised access to your account and associated downloads. You acknowledge that anyone that knows your username and password will be able to download and any associated costs or liability are your responsibility. 

9.       Data Security

News strives to ensure the security, integrity and privacy of personally identifiable information of our customers. We use a variety of physical and electronic security measures including restricting physical access to our offices and firewalls and secure databases to keep personal information secure from misuse, loss or unauthorised use or disclosure. No data transmission over the Internet or storage can be guaranteed to be totally secure.

 

* In following sections marked with the asterisk, a reference to “you” is a reference to you and those members of your household whom you have authorized to use your username and password in accordance with these terms and conditions.

10.       Licences*

For the purpose of accessing and using any News Digital Media, News grants to you a non-exclusive, non-transferable personal licence in relation to the software, including the ability to access and view content and other features within our News Digital Media. News does not transfer title to nor grant any interest in software to you. 

11.       Intellectual Property*

11.1.   All intellectual property in relation to content on the News Digital Media belongs to News or its licensors, advertisers or affiliates. You obtain no interest in that intellectual property. All content on the News Digital Media is protected by Australian and international copyright and other intellectual property laws. You may not do anything which interferes with or breaches those laws or the intellectual property rights in the content.

 

11.2.    You may download and view content or print a copy of material on the News Digital Media for personal, non-commercial use provided you do not modify the content in any way (including any copyright notice). All rights not expressly granted under these terms of use are reserved by News. Unless expressly stated otherwise, you are not permitted to copy, or republish anything you find on any News Digital Media without the copyright or trademark owners’ permission.

 

11.3.    The logos of the News Sites, the newspaper mastheads on the News Sites and the logos of all our other News Digital Media are registered trademarks of News, its related bodies corporate or its licensors. Other trademarks may be displayed on the News Digital Media from time to time. These may belong to third parties. Nothing displayed on the News Digital Media should be construed as granting any licence or right of use of any logo, trademark or masthead displayed on or within those media, without the express written permission of the relevant owner.

12.       Liability & Indemnity*

12.1.    News does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act 2010 (ACL) which cannot be excluded, restricted or modified. However, News excludes all other rights, remedies, guarantees, conditions and warranties in respect of your Registered Access, any membership or subscription, this Site or any of the News Digital Media whether based in statute, common law or otherwise to the extent permitted by law. To the fullest extent possible and subject to News’ liabilities and obligations under the ACL:

 

a)      News and its related entities do not warrant the accuracy of the content on the News Digital Media. The content is provided to you “as is” and on an “as available” basis and on the condition that you undertake all responsibility for assessing the accuracy of the content and rely on it at your own risk;

b)      All content on this Site or any News Digital Media may be changed at the sole discretion of News and its related entities without notice except that if News materially changes the content which you access through your Registered Access or any membership or subscription so that the breadth or nature of the service you receive is materially altered, News will take the steps as described in these terms to notify you of those changes, where practicable.

c)        News and its related entities will have no responsibility or liability in relation to any loss or damage that you incur, including damage to your software or hardware, arising from your Registered Access, any membership or subscription, any membership to our digital services or your use of or access to this Site or any News Digital Media that is not due to News' negligence, wilful misconduct and/or fraud.

d)       News and its related entities do not warrant that functions contained in this Site or any News Digital Media, such as hyperlinks, will be uninterrupted or error free, that defects will be corrected or that News or the server that makes it available, are free of viruses or bugs.

13.       Other

These Registration Terms and Conditions shall be governed by and interpreted in accordance with the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales, Australia and the courts of appeal from them.


Subscription Terms & Conditions

TERMS AND CONDITIONS

1.    General

1.1. In these terms and conditions News Pty Limited will be referred to as News.

1.2. These Terms and Conditions apply to all CODE Sports subscription products regardless of how often/when payment is made, including:

  1. CODE Digital
  2. CODE Sports Digital
  3. CODE Subscription
  4. CODE Sports Subscription
  5. CODE Sports Pass (Pass)
  6. CODE Sports Lite (Lite)

whether these subscriptions are for plans (eg a 12 month plan), renewing subscription terms, fixed subscription terms, recurring periodic payments, lump sum up front payments or are complementary, but excludes subscriptions which are purchased or provided as group or corporate subscription, Apple iTunes, Google Play or an app store.

Each of these is a Subscription which gives you a Digital Membership under these Terms and Conditions.

1.3. These terms and conditions are deemed to include by reference the Registered Access Terms and Conditions which are available here. Defined terms there will be used in these terms also. You must have a valid and current Registered Access to have a valid Subscription.

1.4. News or its relevant related companies may change any applicable terms and conditions from time to time. If this happens, amendments will be posted on the affected News Sites or other News Digital Media and will also be accessible through your login to My Account. If you object to changes to any terms or conditions you may cancel your Subscription up to 28 days after changes come into effect without accepting the new terms and conditions. If you do not cancel or you use or access any News sites or News Digital Media (other than to review the new terms and conditions) using your Subscription within that period you will be deemed to have accepted the new terms.  You may call Customer Support on 1300 MY NEWS (1300 69 63 97) , who will consider your position acting reasonably, if you have reasonable grounds for not having cancelled within the 28 day time limit and still wish to cancel.

 

2.    Digital Membership Content

2.1. Unless your Subscription is for limited specific content as stated at the time of subscription (e.g an app only, Pass or Lite access), your Digital Membership provides you access via a secure login to view unlimited content on the following News sites (Included Media):

  • CODESports.com.au
  • supercoach.com.au (including SuperCoach Plus features)

as well as the following iPad, iPhone and Android applications, when available:

  • CODE Sports
  • And SuperCoach Plus features

If you access SuperCoach Plus, or any other of the Included Media, you will be deemed to have accepted the terms and conditions for the accessed products. The terms and conditions for SuperCoach Plus are available at www.supercoach.com.au/terms-conditions.

2.2. The above lists may change from time to time, at our discretion.  News will endeavour to contact you at least 14 days prior to effecting the removal of any media from these lists.

2.3. Your Digital Membership will commence immediately on receipt by us of completed subscription details, including, when applicable, a successful payment. Confirmation of acceptance will be provided to you via your nominated email address.

2.4. Each username and password is assigned to a single user.  You must ensure that your username and password remain secure and are only shared with the residents of your household i.e. family and friends that live at the same residential address.  However you agree that your Digital Membership cannot be used with more than four devices concurrently. You are responsible for all use, activities and charges associated with your username and password. Your username and password are not otherwise transferable.

2.5. Your Digital Membership may be used for non-commercial purposes only.

 

3.     Story Gifting Terms and Conditions

Story gifting is done through generation of a unique URL or gift link. As an eligible subscriber (excludes those who have only a CODE Sports Lite or CODE Sports Pass subscription), if you are logged in, you can gift up to 5 gift links (in aggregate across the app and the website) in each successive 28 day period from within the app or on the website. Each gift link can be used by only one person (whether or not they are a subscriber) to access one story on a single device. When you generate a gift link, this counts towards your 5 stories limit even if you do not gift it to anyone. If you send a single gift link to more than one person, then once one person has used that link by clicking on it, no-one else will be able to use that link to access our content (unless it is unlocked content which is free to everyone to access). The right to gift up to 5 links does not accrue from one 28 day period to the next. You may only send a gift link to someone who has consented to receive it.

 

4.    Digital Subscriptions with limited access to content


   4.1  Pass Terms & Conditions

              (a)   News may offer a CODE Sports Pass from time to time to individual users (“Invitees”). Whether to include a user as an Invitee and whether to include any other condition (such as that the Invitee is also a CODE Sports Lite subscriber) is determined by News in its absolute discretion.

              (b)   Each offer for a CODE Sports Pass is not transferable and may not be shared with others.

              (c)   If allocated to you, a CODE Sports Pass entitles you to access a limited number of locked articles within a limited period of time only on the CODE Sports website. The specific number of articles and the applicable time period ('Pass period') are as specified at the time of signing up to the CODE Sports Pass. Despite anything else, the CODE Sports Pass does not provide any other rights to access our content including on other sites or via the CODE Sports app.

              (d)   Any unused articles at the end of your Pass period will be forfeited.

              (e)   An Invitee is only entitled to one active CODE Sports Pass at any given time.

              (f)   Any access to sign up for a CODE Sports Pass (including by way of a link), may only be used once and only by the user to whom it was sent by News.

              (g)   News may cancel any access to a CODE Sports Pass or any access to sign up for a CODE Sports Pass (including by way of a link)  if it reasonably believes it is being used, or distributed with a view to it being used, in breach of these Terms and Conditions.

              (h)   The number of articles included and the entitlements may change from time to time, at our discretion. News will endeavour to provide reasonable notice prior to any changes becoming effective. If you object to any such changes you may cancel your CODE Sports Pass without accepting the changes. If you do not cancel or you use your CODE Sports Pass (other than to review the changes) within that period you will be deemed to have accepted the changes.

 

  4.2  Lite Terms & Conditions

               (a)  News may offer a Lite subscription for CODE Sports from time to time to individual users (“Invitees”). Whether to include a user as an Invitee and whether to include any other condition is determined by News in its absolute discretion.

               (b)   Each offer for a Lite subscription is not transferable and may not be shared with others.

               (c)   A Lite subscription entitles you to access selected games, and certain other features, and tools on CODE Sports website or via the app. Despite anything else, the Lite subscription does not provide any other rights to access our content including other locked content on the website or via the app.

               (d)  An Invitee is only entitled to one active Lite subscription at any given time.

               (e)  Any access to sign up for Lite (including by way of a link), may only be used once and only by the user to whom it was sent by News.

               (f)  News may cancel any access to Lite or any access to sign up for Lite (including by way of a link)  if it reasonably believes it is being used, or distributed with a view to it being used, in breach of these Terms and Conditions.

               (g)  The entitlements of a Lite subscription may change from time to time, at our discretion. News will endeavour to provide reasonable notice prior to any changes becoming effective. If you object to any such changes you may cancel your Lite subscription without accepting the changes. If you do not cancel or you use your Lite subscription (other than to review the changes) within that period you will be deemed to have accepted the changes.

 

5.    Access from outside of Australia

You acknowledge that some of our content may not be viewable or accessible from outside of Australia.

 

6.    Pricing

6.1. The price of the subscription, including where applicable any introductory pricing for a specified period will be displayed at the time of purchase. All prices include GST unless otherwise specified.

6.2. News may amend the pricing schedule by giving 28 days prior notice to you.  Once new pricing takes effect, News may alter your automatic payment arrangements accordingly.

6.3. Where your Subscription is for a specified plan period or a fixed term with regular, periodic payments (with or without a further term on the same or different terms) then the total price that you will pay is the total sum of all regular periodic payments throughout the specified plan period or fixed term (plus the relevant price for any relevant further terms prior to cancellation being effected). News will not change the pricing for a plan period or fixed term subscription during that fixed term.

6.4. Information about your current Subscription, including its price is available in My Account under Manage My Subscriptions or you can call Customer Support on 1300 MY NEWS (1300 69 63 97).

 

7.   Payment, Fees and Taxes

Payments in advance

7.1. If payment is required to be made by an upfront payment or by automatic recurring payments (for example 4 weekly or monthly), then those payments must be made via PayPal, Google Pay, or Apple Pay (when available as specified by News when the offer is made) or debit/credit cards.  Payments are made in advance. American Express, Visa, MasterCard and Diners Club credit cards are accepted. The recurring payment for the amount of the offer you have requested will be automatically charged by News every 4 weeks or monthly (depending on the offer terms) in advance, subject to the terms set out below, until such time as the subscription is terminated in accordance with these terms and conditions.

7.2. The second payment of auto-renewing subscriptions will be made up to 7 days prior to the commencement of the second billing period and will thereafter occur with the stated frequency of 4 weekly or monthly.

7.3. Changes to payment details can be made online via My Account or by contacting Customer Support on 1300 MY NEWS (1300 69 63 97).

7.4. If payment fails, we will attempt to notify you and request that you update your payment details. We will re-attempt payment several times.  During this period, we will grace your subscription for up to 5 days after which time we will commence the cancellation process.

7.5. If you are under the age of 18 you require consent from your parent or guardian and the card holder to authorise charges to be made.

7.6. For the purpose of auto-renewing your Subscription, your PayPal or credit card details are stored in a tokenised, encrypted format. They are therefore available should you elect to purchase another subscription.

7.7. You can only sign up to a Subscription for yourself. You cannot sign up another person as a gift to them.

 

8.     Direct Debit

From credit/debit card or PayPal accounts

8.1. By providing us with your credit or debit card or PayPal account details or paying with Google Pay or Apple Pay you authorise us to charge all amounts payable in relation to your subscription to the nominated payment account in accordance with the payment terms section above.

8.2. You must ensure that you have sufficient funds in your account to honour the payment. If there are insufficient funds, we may continue to attempt to process the payment a number of times.

8.3. It is your obligation to advise us of any changes to your payment account details.

8.4. We may continue to process your payments after the original expiry date of your credit or debit card as advised to us.

8.5. We may, on providing you with reasonable notice in the circumstances, cancel this direct debit arrangement at any time. This might happen where there have been dishonoured or rejected payments, or if we have a reasonable suspicion that fraudulent information has been provided in relation to your direct debit arrangement. Where we cancel a direct debit payment method, we will notify you of the cancellation and request the establishment of an alternative method of payment.

 

9.    Pausing a Subscription

9.1. Eligible Subscriptions can be paused online via My Account or by contacting Customer Support on 1300 MY NEWS (1300 69 63 97). A subscriber may only pause an eligible subscription for a period of either 4, 8, or 12 weeks at a time and up to a total of 100 days during a 12 month period.

9.2. The following types of digital subscriptions are not eligible to be paused (unless expressly stated to the contrary in the subscription terms): Lite, Pass, Corporate, Campus and University, Teachers and Students, IP Access, Schools, Fixed Term with a lump sum up front payment which do not auto-renew or auto-rollover for one or more additional periods, gift subscriptions, free subscriptions and any subscriptions in the last 6 days of their subscription term. We may vary this list from time to time and, despite any other requirements in these terms relating to amending or varying the terms, our only obligations in relation to any such change is that we provide reasonable advance notice to those subscribers directly impacted by the impending change and those subscribers will then have the right to cancel their subscription within 28 days of such notice and receive a pro rata refund of any prepaid subscription fees. We will then update these terms from time to time to reflect any such implemented changes. 

9.3. You will not be charged for your Subscription for the duration it is paused and the time until your next payment date will be extended by a period of time equal to the length of time the subscription is paused. After the pause period has concluded your subscription entitlements and billing will automatically resume.

9.4. While your Subscription is paused you will not have access to your Subscription entitlements, including but not limited to, access to locked content across the Included Media Sports, and access to SuperCoach Stats AFL and SuperCoach Stats NRL.

9.5. While paused you may resume your Subscription early at any time online via My Account or by contacting Customer Support on 1300 MY NEWS (1300 69 63 97). If you resume your Subscription early your Subscription entitlements and billing will automatically resume.

 

10.    Cancellation, Termination and Refunds Policy

10.1. Your Subscription will continue until cancelled by either one of us or, for fixed term subscriptions, until the end of the fixed term specified at the time you signed up for the subscription unless cancelled earlier in accordance with these terms. You may cancel your Subscription by calling Customer Support on 1300 MY NEWS (1300 69 63 97). You must provide a minimum of 7 business days’ notice, if you want to cancel your subscription. Cancellations will take effect at the end of the subscription period, which is current at the end of the 7 business day notice period.

10.2. If your subscription consists of both a Digital Membership and Newspaper Delivery subscription, you may not cancel just one component. Please contact Customer Support on 1300 MY NEWS (1300 69 63 97) to discuss other subscription alternatives that may suit your needs.

10.3. The following applies regarding refunds.

  1. If your Subscription requires you to pay to News:
    1. Subscription fees in advance every 4-weeks; or
    2. Subscription fees in advance monthly; or
    3. An initial payment which is stated to be non-refundable in the offer terms,
       then those prepaid fees are not refundable, in whole or in part, unless:
    4. News cancels your subscription, other than due to a breach by you of our terms and conditions;
    5. You or News cancel your Newspaper Delivery because News no longer provides home delivery to your delivery address;
    6. You cancel your subscription because we materially reduce the Included Media or the content made available through your subscription except that this does not apply if; or
    7. It is required by law.
  2. If your subscription payments are made to News and are other than described in paragraph 1 above, if you cancel your subscription before the end of a prepaid subscription period, you will be entitled to a prorated refund for any unused and prepaid days
  3. If your subscription is for a specified plan period or a fixed term with regular periodic payments throughout the term then you may not cancel your subscription prior to the expiry of the specified plan period or fixed term (so for example, where your subscription requires a payment every 4 weeks for 52 weeks then you may not cancel your subscription to take effect before the expiry of the first 52 weeks).
  4. If you pay an app store provider for your subscription then that app store provider will determine your refund eligibility.

10.4. News may cancel your subscription at any time on reasonable notice and acting reasonably. Where cancellation by us is due to your breach of our terms and conditions including for any Included Media, we are under no obligation to provide any refund or notice.

11.    Various

These Terms & Conditions and any agreement which includes or incorporates these Terms and Conditions shall be governed by and interpreted in accordance with the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales, Australia and the courts of appeal from them.
